These Terms of Service ("Terms") govern your use of the Medcorder mobile application and related services (collectively, the "Service") operated by Medcorder, Inc. ("Medcorder," "we," "us," or "our"). By using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use Medcorder. If you are under 18, you must have permission from a parent or legal guardian.

2. Account Registration

To use Medcorder, you must create an account using your phone number. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to provide accurate information and to update it as necessary.

3. Recording Consent

You are solely responsible for obtaining any required consent before recording a conversation. Medcorder prompts you to confirm that you have your physician's consent before each recording, but the responsibility for compliance with applicable recording laws rests with you. Recording laws vary by jurisdiction. We recommend always informing your healthcare provider before recording.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Record conversations without proper consent
  • Use the Service to harass, threaten, or harm others
  • Upload content that is unlawful, defamatory, or infringes on the rights of others
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the Service for any commercial purpose not expressly authorized by Medcorder
  • Reverse-engineer, decompile, or disassemble any part of the Service

5. Your Content

You retain ownership of all recordings, transcripts, notes, and other content you create through the Service ("Your Content"). By using the Service, you grant Medcorder a limited license to store, process, and transmit Your Content solely for the purpose of providing the Service to you and the people you choose to share it with.

You may delete Your Content at any time. When you delete content, it will be removed from our active systems within a reasonable timeframe, though backup copies may persist for a limited period as part of our standard data backup procedures.

6. Sharing and Privacy

When you invite others to an appointment room, they will have access to all recordings, transcripts, and notes within that room. You are responsible for choosing who to share your medical information with. Medcorder is not responsible for how recipients use information you share with them.

7. Medical Disclaimer

Medcorder is a recording and communication tool. It does not provide medical advice, diagnosis, or treatment. Transcriptions are generated automatically and may contain errors. Always consult your healthcare provider for medical decisions and verify any information from transcripts directly with your provider.

8. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

9. Intellectual Property

The Medcorder name, logo, and all related trademarks, service marks, and trade names are the property of Medcorder, Inc. The Service and its original content (excluding Your Content) are protected by copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, Medcorder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Medcorder's total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to Medcorder in the twelve months preceding the claim (or $100 if you have not made any payments).

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that transcriptions will be accurate, complete, or error-free.

12. Indemnification

You agree to indemnify and hold harmless Medcorder and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by other means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. Any legal action arising from these Terms shall be filed in the state or federal courts located in San Mateo County, California.
